2023 set for UK Employment Legislation updates!

Under the Retained EU Law (Revocation and Reform) Bill, which was introduced on 22 September 2022, any retained EU law will automatically expire on 31 December 2023, unless specific UK legislation is introduced to retain or reform it.


Current employment legislation that may become obsolete or change includes:  Agency Workers Regulations; Fixed-term Employees Regulations; Part-time Workers Regulations; Parental Leave; Information and Consultation of Employees (ICE) Regulations; and some aspects of TUPE.


There is likely also to be a reform to the way EU case law is interpreted by the tribunals and courts, with the lower courts, including employment tribunals, being able to ask appeal courts if they are still bound by EU retained case law.  We await further developments with interest but, along with the repeal of IR 35 regulations, it means that employers will have to stay alert to proposed changes.
