Additional Legal Protection for Parents and Carers

The pending employment legislation updates relating to Neonatal Care (Leave and Pay) Act 2023, the Protection from Redundancy (Pregnancy and Family Leave) Act 2023 and the Carer’s Leave Act 2023 have received Royal Assent. This legislation will amend the Employment Rights Act 1996, in order to give additional employment protections to parents and unpaid carers in the workplace.   

Neonatal Care (Leave and Pay) Act 2023 – Eligible parents will be entitled to take up to 12 weeks of paid leave when their new-born baby is admitted into neonatal care. These 12 weeks of paid leave are in addition to any other statutory paid leave that the parents are entitled to, such as maternity, paternity or adoption leave.

Protection from Redundancy (Pregnancy and Family Leave) Act 2023 –This change extends the current protection of automatic entitlement to be offered alternative roles during any period of family leave by a further 6 months from when the employee returns to work from a period of maternity, adoption or shared parental leave. It also extends the protection to when pregnant employees inform their employer that they are pregnant (before they start a period of maternity or shared parental leave).

Carer’s Leave Act 2023 – A new statutory entitlement to one week of unpaid leave for employees who are caring for a dependant with a long-term care need.
