Security manager awarded £360k for constructive dismissal related to racism
A long-serving black employee at a UK security firm was awarded more than £360,000 in compensation following a successful claim for victimisation and constructive dismissal due to persistent racial incidents and bullying over several years.
The employee experienced a series of racially insensitive and discriminatory incidents over a period of ten years. These included being referred to as a “slave” in front of others, discovering a mug with the word “slave” in the office, being questioned where he learned English, despite his language skills being impeccable; overlooked for promotion despite having the required qualifications and experience plus laptop being monitored without consent.

Despite multiple complaints about racially charged remarks and unequal treatment went unresolved or were handled informally. After raising a formal grievance alleging bullying and race discrimination, the employee was suspended without warning and faced an investigation for misconduct. The tribunal criticised this as procedurally flawed and lacking justification.
The grievance was not adequately addressed, and he was left feeling severely distressed, leading to a formal resignation citing racism, bullying, and harm to his mental health.
The employment tribunal upheld claims of victimisation and constructive dismissal and awarded compensation: £360,705.
Victimisation can result in significant liability and procedural fairness is critical when handling grievances and disciplinary matters. Employers must act on complaints appropriately and ensure that grievance processes are transparent and fair.
