Unlawful redundancy award

A former tearoom worker has been awarded £12,183 after a tribunal found her redundancy was unlawful. The case found that the employer had failed to provide the correct 11-week notice period required to be paid. In addition, there was failure to pay accrued holiday pay.  The employee, who had worked there for 11 years, was also found to be unfairly dismissed, even though the business was closing.

This case evidences that even in genuine redundancies such as a business closure, employers must follow proper legal process, especially around notice, pay, and entitlements, or risk compensation claims.   In this case there was a failure to apply correct payment methodology and an assumption that, because the business had closed, no notice was due.
