Property Manager awarded £400k after being refused holiday
A property manager was awarded nearly £400,000 after being unable to take annual leave for 25 years due to staff shortages.
An agreement allowed his unused holiday to roll over each year and be paid later. By the time he was dismissed in 2024, he had accumulated 827 days of unused leave, but the company failed to pay him for it.
The tribunal found that a valid agreement existed to carry over and eventually pay for unused leave. The dismissal for “gross misconduct” was unfair and procedurally flawed.
The award was £392,000 for unpaid holiday and additional compensation for unfair dismissal. Employers who allow unused holiday to build up without proper management or clear policies risk massive financial liabilities when employment ends.
With new regulations in place for maintenance of holiday records, it is imperative that an employer maintains records of holiday requests taken and those carried forward if appropriate. Contact 121 HR Solutions to ask for a demonstration of Breathe HR software which includes holiday recording.
