Can a company car become a pool car?
As businesses continue to review costs, many employers are looking at company car arrangements differently, particularly where employees no longer want the associated fuel card or personal use element.
A recent query raised whether an allocated company car could simply become a “pool car” instead. The answer is, potentially yes, but employers should be careful.
If the vehicle has historically been linked to one employee, used personally, or formed part of their wider benefits package, changing the arrangement can create both employee relations and HMRC risks if not handled properly.
A genuine pool car should:
-
be shared between employees,
-
mainly be used for business purposes,
-
and not effectively operate as one employee’s personal vehicle
For SMEs, the key risk is assuming this is just an operational change when, in reality, the employee may view it as a change to their contractual benefits.
Before making changes, employers should:
-
check the contract and company car policy,
-
consult with the employee,
-
explain the business reasons clearly,
-
and confirm any revised arrangements in writing
Like many employment issues, the risk is often not the change itself, but poor communication, inconsistency, or failing to properly consider the contractual position first.
