A baby born early could trigger more than maternity leave

A recent client query highlighted a situation that many employers may not have considered.

An employee had advised that their baby was likely to be born earlier than expected due to medical complications. Naturally, the immediate focus was on supporting the employee and their family, but it also raised an important question for the employer… what employment rights are triggered when a baby arrives prematurely?

The most obvious entitlement is maternity leave. Where a baby is born before the expected week of childbirth, maternity leave will normally begin automatically from the day after the birth, regardless of when it was originally intended to start.
Employers should also be aware of the newly implemented Neonatal Care Leave and Pay provisions, which came into force in April 2025. Where a baby requires neonatal care shortly after birth and the qualifying conditions are met, eligible parents may be entitled to up to 12 weeks’ additional leave on top of their existing family leave entitlements. The legislation recognises that parents should not lose valuable family leave because their baby requires specialist hospital care at the very start of their life.

Depending on the circumstances, an employer may therefore need to consider a combination of maternity leave, paternity leave and neonatal care leave, each with their own qualifying rules and entitlements.

Whilst compliance with the legislation is essential, employers should also remember the personal circumstances surrounding these situations. A premature birth or a baby requiring neonatal care is often an extremely stressful and emotional experience for families. Clear communication, empathy and practical support can make a significant difference during what is already a difficult time.

Many employers will rarely encounter neonatal leave, but when they do, it often arises unexpectedly. Having up-to-date family-friendly policies and understanding the newly implemented legislation will help ensure your business remains compliant while providing the support employees need when they need it most.

As family-friendly rights continue to evolve, taking advice early can help employers navigate what are often complex situations with confidence, ensuring both the business and the employee are protected.
