My apprentice has finished… can I just end their employment?
For many employers, apprenticeships are a fantastic way of developing new talent. But one question regularly catches businesses out.
“The apprenticeship has finished, so the employment automatically ends… doesn’t it?” The short answer is not necessarily.
Whilst apprentices are not guaranteed a permanent job once their apprenticeship comes to an end, simply allowing the apprenticeship to expire without following a fair process can expose employers to unnecessary legal risk.
Many apprentices are employed on fixed-term contracts linked to the duration of their apprenticeship. However, if you decide not to offer ongoing employment, this is still regarded as a dismissal, and a fair process should be followed. Employers should explain the reasons for the decision, meet with the apprentice, confirm the outcome in writing and provide the right of appeal.
Apprentices have the same employment rights as employees, including rights relating to working time, annual leave, discrimination and dismissal. If an apprentice continues working after completing their apprenticeship, their apprenticeship service will also count towards their continuous employment. This means their employment doesn’t simply “start again” once they become a permanent employee.
Where employers are considering not offering a permanent role because there is genuinely no ongoing requirement for the position, it’s important that this is properly documented and communicated. Equally, if concerns relate to performance or conduct rather than the end of the apprenticeship itself, those issues should be addressed during the apprenticeship rather than waiting until the end of the programme.
The end of an apprenticeship doesn’t automatically mean the end of employment. Before making any decision, check the apprenticeship agreement, consider whether there is a genuine business reason for not offering continued employment and ensure a fair dismissal process is followed.
Getting this right not only reduces the risk of employment claims but also demonstrates fairness to employees who have invested time developing their skills within your business.
